1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and JambKit Ltd, the operator of JambKit ("we", "us", "our"), governing your access to and use of the JambKit platform, including our mobile apps, web app, and website at jambkit.com (collectively, the "Service").

By registering for an account, subscribing to a plan, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

To use JambKit, you must:

• Be at least 13 years of age. Users under 18 should have parental or guardian consent.
• Have the legal capacity to enter into a binding agreement under the laws of the Federal Republic of Nigeria.
• Not be prohibited from receiving our services under any applicable law or regulation.

By using JambKit, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access most features of JambKit, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account information updated.
• Maintain the confidentiality of your password and not share it with anyone.
• Immediately notify us if you suspect unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.

4. Description of Service

JambKit is an educational platform providing JAMB UTME preparation tools, including:

• Practice questions drawn from JAMB past papers (2010–2024) across 15+ UTME subjects.
• Four exam modes: Practice Mode, Mock UTME, SpeedBlaze, and Topic Drill.
• Live video classes taught by qualified instructors (Scholar plan).
• An AI Tutor providing step-by-step explanations (Regular and Scholar plans).
• Study notes, videos, progress analytics, gamification, and achievement badges.
• An Admission Hub for calculating university aggregates and navigating JAMB CAPS.

JambKit is an educational tool designed to assist with exam preparation. It does not guarantee any particular JAMB score or university admission outcome.

5. Subscription Plans and Payment

JambKit offers three access tiers:

5.1 Payment Processing

All payments are processed securely by Paystack. By subscribing, you authorise Paystack to charge your payment method for the applicable subscription fee. We do not store your card details. Your use of Paystack's services is subject to their Terms of Service.

5.2 Subscription Renewal

Annual subscriptions do not auto-renew. You will receive a reminder notification before your subscription expires. To continue access, you must manually renew by making a new payment.

5.3 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period — they take effect only upon renewal. We will notify active subscribers of any price change at least 30 days in advance.

6. Refund Policy

Due to the digital nature of our service, all subscription purchases are generally non-refundable once the subscription has been activated and access has been granted.

Exceptions may be considered in the following circumstances:

• You were charged in error (e.g., duplicate payment).
• The Service was materially unavailable for an extended period due to our fault.
• You contact us within 48 hours of purchase and have not yet accessed any paid features.

To request a refund, contact us with your transaction reference at the details in Section 15. Refund decisions are made at our sole discretion.

7. Acceptable Use

You agree to use JambKit only for lawful, personal, and educational purposes. You must not:

• Share your account credentials with others or allow multiple users to access one account simultaneously.
• Copy, reproduce, distribute, or commercially exploit any content from JambKit without our prior written consent.
• Attempt to reverse-engineer, decompile, scrape, or extract data from our platform by automated means.
• Upload, transmit, or share any content that is unlawful, defamatory, obscene, or harmful.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to any part of the Service or its supporting infrastructure.
• Misrepresent your identity or impersonate any person or entity.
• Use the Service in any way that violates applicable Nigerian law or regulation.

Violation of these terms may result in immediate suspension or termination of your account without refund.

8. Content and Intellectual Property

8.1 Our Content

All content on JambKit — including but not limited to questions, explanations, study notes, videos, software, graphics, logos, and the JambKit name and brand — is the property of JambKit Ltd or its licensors and is protected by Nigerian copyright law and applicable international treaties.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use this content for your personal, non-commercial educational purposes only.

8.2 JAMB Past Questions

Questions drawn from past JAMB examinations are the intellectual property of the Joint Admissions and Matriculation Board (JAMB). JambKit uses these questions for educational purposes. We are not affiliated with or endorsed by JAMB.

8.3 User-Generated Content

If you submit feedback, suggestions, or other content to JambKit, you grant us a royalty-free, perpetual licence to use, incorporate, and publish that content to improve the Service. You retain ownership of your submissions.

9. Live Classes

Live classes are available exclusively to Scholar plan subscribers. The following additional terms apply:

• Class schedules are published in advance and may change. We will notify subscribers of any significant changes.
• Missed live classes may be available as recordings at our discretion.
• You must not record, screenshot, or re-distribute live class content without our written permission.
• Disruptive behaviour in class chat or Q&A (including spam, harassment, or off-topic content) may result in removal from the class and suspension of your account.

10. AI Tutor

The AI Tutor feature generates responses using artificial intelligence. While we strive for accuracy, AI-generated explanations:

• May contain errors or imprecisions.
• Should not be treated as the sole or authoritative source of academic guidance.
• Are provided as a supplementary learning tool, not a replacement for qualified instruction.

We continually review and improve AI Tutor responses but accept no liability for decisions made solely on the basis of AI-generated content.

11. Disclaimers

JambKit is provided on an "as is" and "as available" basis. To the fullest extent permitted by Nigerian law, we disclaim all warranties, express or implied, including:

• That the Service will be uninterrupted, error-free, or secure at all times.
• That any particular JAMB score or admission outcome will be achieved by using the Service.
• That all questions or content are free from inaccuracies.

12. Limitation of Liability

To the maximum extent permitted by Nigerian law, JambKit Ltd shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, JambKit.
• Any loss of data, lost profits, or loss of educational opportunity.
• Any damages resulting from errors or omissions in our content.
• Any third-party actions, including those of Paystack or other service providers.

In any event, our total liability to you for claims arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless JambKit Ltd, its directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your use of the Service; or (c) your violation of any applicable law or third-party right.

14. Termination

Either party may terminate the relationship described by these Terms at any time:

• You may delete your account at any time through the app settings. Deletion of your account does not entitle you to a refund of any unused subscription period.
• We may suspend or terminate your account immediately, without notice, if you breach these Terms, engage in fraudulent activity, or if required to do so by law.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 8, 11, 12, 13, and 16) will continue to apply.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these Terms or your use of JambKit shall be resolved as follows:

• Informal resolution: Contact us first. We will make every reasonable effort to resolve disputes informally within 30 days.
• Mediation: If informal resolution fails, disputes shall be submitted to mediation in Lagos State, Nigeria, before proceeding to litigation.
• Jurisdiction: Failing resolution by mediation, the courts of Lagos State, Nigeria, shall have exclusive jurisdiction over any dispute.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify active subscribers by email or via an in-app notice at least 14 days before the changes take effect.

Your continued use of JambKit after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

17. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and JambKit Ltd regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
• Assignment: We may assign these Terms to a successor entity. You may not assign your rights or obligations under these Terms without our written consent.
• Force majeure: We are not liable for failures or delays caused by events beyond our reasonable control, including but not limited to acts of God, government actions, internet outages, or third-party service failures.
